OVERVIEW

Welcome to HairMed™.

HairMed™ is a brand operated by KSS Global Solutions LLC, a Wyoming limited liability company (“HairMed,” “we,” “us,” or “our”).

We operate this website, online store, assessments, account features, subscription services, content, tools, products, and related services (collectively, the “Services”).

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer products and Services to you. Shopify does not provide HairMed’s products, clinical services, customer support, or treatment recommendations.

These Terms of Service (“Terms”), together with all policies incorporated by reference, describe your rights and responsibilities when accessing or using the Services.

By visiting our website, creating an account, completing an assessment, purchasing a product, enrolling in a subscription, or otherwise using the Services, you agree to these Terms and our:

If you do not agree with these Terms, you must not access or use the Services.


SECTION 1 — ELIGIBILITY, ACCESS, AND ACCOUNTS

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services, complete a medical assessment, or purchase products from HairMed.

The Services are intended for customers located in the United States and may not be available in every state or jurisdiction.

Certain clinical services, treatment plans, products, or prescription options may be subject to additional eligibility requirements based on your:

  • Age;
  • Location;
  • Medical history;
  • Current medications;
  • Health conditions;
  • Provider assessment; and
  • Applicable law.

You agree to provide complete, accurate, and current information when creating an account, completing an assessment, communicating with a healthcare provider, or placing an order.

You are responsible for:

  • Maintaining the confidentiality of your login credentials;
  • All activity performed through your account;
  • Keeping your email, shipping address, billing information, and payment method current;
  • Preventing unauthorized access to your account; and
  • Immediately notifying us of suspected unauthorized activity.

You may not transfer, sell, assign, or allow another person to use your account.


SECTION 2 — HAIRMED SERVICES

HairMed provides an online experience that may include:

  • Educational information relating to hair loss and hair health;
  • Online assessments and questionnaires;
  • Access to telemedicine or clinical review;
  • Personalized treatment recommendations;
  • One-time and subscription-based products;
  • Ongoing treatment support;
  • Account and subscription management; and
  • Recurring delivery of eligible products.

Availability of a particular service or product does not mean that it is appropriate or available for every customer.

We may add, modify, restrict, suspend, or discontinue any part of the Services at any time, subject to applicable law.


SECTION 3 — TELEMEDICINE AND CLINICAL SERVICES

Certain HairMed Services may include access to licensed healthcare professionals through telemedicine.

Clinical services are separate from the general educational and e-commerce functions of the website. You may be required to accept additional:

  • Telehealth consent forms;
  • Medical treatment consents;
  • Provider terms;
  • Pharmacy terms;
  • Notices of privacy practices; or
  • State-specific disclosures.

Those additional terms will apply to the relevant clinical service. If there is a conflict between these Terms and an informed consent or clinical agreement, the clinical agreement will control with respect to the clinical service.

Completing a questionnaire or assessment does not guarantee that:

  • You will qualify for treatment;
  • A healthcare provider will approve a treatment plan;
  • A specific product will be recommended;
  • A prescription will be issued; or
  • A previously approved treatment will continue.

Healthcare providers exercise independent professional judgment. HairMed cannot require a provider to prescribe, approve, continue, or modify a treatment.

A provider may request additional information, photographs, records, laboratory testing, a video consultation, or an in-person evaluation before making a decision.

You agree to provide truthful and complete health information and to notify the clinical team of any relevant changes.


SECTION 4 — NOT FOR EMERGENCIES

The Services are not intended for medical emergencies.

Do not use the HairMed website, assessment, messaging system, or customer support for an emergency.

If you believe you are experiencing a medical emergency, call 911 or seek immediate emergency medical care.

HairMed is not a replacement for your primary care physician, dermatologist, or other healthcare providers.


SECTION 5 — MEDICAL INFORMATION AND TREATMENT RESULTS

General content available through the website is provided for educational and informational purposes only.

Website content that is not communicated directly to you by a licensed healthcare professional as part of your clinical care should not be considered:

  • A diagnosis;
  • Individual medical advice;
  • A prescription;
  • A guarantee of eligibility; or
  • A substitute for professional medical care.

Individual results vary. HairMed does not guarantee that any product or treatment will:

  • Stop hair loss;
  • Produce hair regrowth;
  • Restore a particular amount of hair;
  • Work within a specific period;
  • Produce the same outcome as another customer; or
  • Be suitable for every individual.

You are responsible for following all instructions provided by the healthcare professional, product label, medication guide, or other authorized source.

You should promptly report side effects, adverse reactions, or material changes in your health to the appropriate healthcare provider.


SECTION 6 — PRODUCTS

We make reasonable efforts to display and describe products accurately. However, product appearance, packaging, color, size, labeling, and other details may differ from how they appear on your screen or from images used on the website.

Product packaging may change without notice when permitted by law.

Descriptions, availability, pricing, formulations, quantities, and product combinations may be changed or discontinued at any time.

Some products may only be available after a clinical review or provider approval.

Products are intended for the customer for whom they were ordered. You may not:

  • Resell them;
  • Share them with another person;
  • Transfer prescription products;
  • Use them contrary to instructions; or
  • Export them for commercial purposes.

Prescription products, when offered, are only available after approval by an authorized healthcare provider and remain subject to all applicable prescribing, dispensing, and fulfillment requirements.


SECTION 7 — ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase.

An order is not accepted until:

  • Payment has been authorized;
  • Any required clinical approval has been completed;
  • The order has passed applicable verification and fraud screening; and
  • We confirm acceptance or begin processing the order.

We may refuse, limit, hold, or cancel an order for reasons including:

  • Product unavailability;
  • Clinical ineligibility;
  • Inaccurate information;
  • Suspected fraud;
  • Payment failure;
  • Legal or regulatory restrictions;
  • Shipping restrictions;
  • Pricing or listing errors; or
  • Suspected resale or misuse.

If we cancel an order after receiving payment, we will issue any applicable refund according to our Refund and Return Policy.

You must review your order carefully before submitting it.

Orders that have already been processed, prepared, dispensed, packed, or shipped may not be canceled.


SECTION 8 — SUBSCRIPTIONS AND AUTOMATIC RENEWAL

Certain HairMed products and treatment plans are sold as subscriptions.

When you enroll in a subscription, you authorize HairMed and its payment processors to automatically charge your selected payment method according to the:

  • Price;
  • Billing frequency;
  • Initial term;
  • Renewal schedule;
  • Shipping frequency; and
  • Other terms shown at checkout.

Subscriptions are generally billed monthly unless otherwise disclosed.

Some plans may include an introductory 3-month or 6-month treatment period, promotional price, minimum initial term, or scheduled price change. The exact conditions displayed before checkout and in your order confirmation form part of your agreement.

If a plan expressly states that it has a minimum initial commitment, you agree to the billing obligations disclosed at checkout, except where cancellation or other rights are required by applicable law.

After any initial term, a subscription may automatically continue and renew until canceled, as disclosed at checkout.

Each successful recurring payment may generate a new order for the applicable shipment.

A shipment will generally not be released when the applicable recurring payment has failed or remains unpaid.

You are responsible for maintaining a valid payment method and sufficient available funds.

We may attempt to process a failed payment again and may notify you to update your payment method.

Repeated payment failures may result in:

  • Delayed fulfillment;
  • Suspension of the subscription;
  • Cancellation of future shipments; or
  • Termination of the subscription.

SECTION 9 — SUBSCRIPTION CANCELLATION

You may request cancellation through the customer account or subscription management portal, when available, or by contacting:

Cancellation must be completed before the next renewal charge is processed to prevent the next billing cycle.

Canceling a subscription:

  • Stops eligible future renewals;
  • Does not automatically cancel an order already charged;
  • Does not automatically refund a completed payment;
  • Does not cancel an order already processed, prepared, dispensed, packed, or shipped; and
  • Does not remove obligations under a clearly disclosed minimum initial term, except where required by law.

If no minimum commitment was clearly disclosed at checkout, cancellation will apply to future billing cycles after it is successfully processed.

You are responsible for retaining confirmation of your cancellation request.

HairMed may also cancel or suspend a subscription when:

  • Payment cannot be collected;
  • A healthcare provider discontinues treatment;
  • Continued treatment is no longer appropriate;
  • Required information is not provided;
  • Products become unavailable;
  • You misuse the Services; or
  • Continuing the subscription would violate applicable law.

Recurring-billing terms should be clearly disclosed before payment and customers should have an accessible cancellation method. Shopify also supports a separate subscription policy and customer subscription management.


SECTION 10 — PRICES, PAYMENT, AND TAXES

Prices, promotions, introductory offers, and discounts may change without notice.

The price applicable to a purchase is the price displayed and accepted at checkout.

Unless expressly stated otherwise, prices may not include:

  • Sales tax;
  • Shipping;
  • Handling;
  • Expedited delivery;
  • Third-party service fees; or
  • Other applicable charges.

Any recurring price, introductory rate, future price increase, or billing frequency will be disclosed at checkout or before the applicable change takes effect.

By providing payment information, you represent that:

  • The information is accurate and complete;
  • You are authorized to use the payment method;
  • You authorize the charges described at checkout;
  • The payment provider may process recurring charges; and
  • You will update expired or inaccurate information.

We may use third-party payment processors. HairMed does not have access to your complete card number after it is securely submitted through the payment system.


SECTION 11 — SHIPPING AND DELIVERY

We currently ship only to eligible addresses in the United States, unless otherwise stated.

Processing and delivery dates are estimates, not guarantees.

Delivery may be affected by:

  • Carrier delays;
  • Weather;
  • Holidays;
  • Address errors;
  • Customs or regulatory review;
  • Product availability;
  • Clinical approval;
  • Payment verification;
  • Events outside our reasonable control; or
  • Other transportation disruptions.

You are responsible for providing a complete and accurate shipping address.

HairMed is not responsible for delays or losses caused by an incorrect address supplied by the customer.

When tracking indicates delivery but you cannot locate the package, you must first check:

  • The delivery location;
  • Household members;
  • Building staff;
  • Neighbors; and
  • The carrier.

Claims for damaged, missing, defective, or incorrect items are handled according to our Refund and Return Policy.

Refusing a package does not automatically entitle you to a refund.


SECTION 12 — RETURNS, REFUNDS, AND ORDER CANCELLATIONS

All returns, refunds, replacements, and order cancellations are governed by our Refund and Return Policy:

Due to the personal-use, hygiene, health, cosmetic, and potentially personalized nature of HairMed products, products that have been processed, prepared, dispensed, shipped, delivered, opened, or used may not be eligible for return.

Exceptions may apply to approved claims involving:

  • Incorrect products;
  • Damaged products;
  • Defective products;
  • Missing items; or
  • Orders that HairMed is unable to fulfill.

SECTION 13 — ELECTRONIC COMMUNICATIONS AND CONSENT

By using the Services, you consent to receive electronic communications relating to:

  • Your account;
  • Assessment;
  • Clinical review;
  • Orders;
  • Payments;
  • Subscription renewals;
  • Shipping;
  • Treatment support;
  • Policy updates; and
  • Customer service.

These communications may be delivered by email, account notification, or other methods you authorize.

Electronic communications, confirmations, disclosures, and agreements satisfy any legal requirement that such communication be in writing, to the extent permitted by law.

Marketing email or text message consent is separate where required, and you may opt out of promotional communications using the instructions provided.

Opting out of marketing messages does not prevent us from sending essential transactional or clinical communications.


SECTION 14 — INTELLECTUAL PROPERTY

The Services and their contents, including:

  • HairMed™ branding;
  • Logos;
  • Product names;
  • Website design;
  • Text;
  • Graphics;
  • Photographs;
  • Videos;
  • Audio;
  • Questionnaires;
  • Software;
  • Layouts;
  • Product descriptions; and
  • Other original materials,

are owned by or licensed to KSS Global Solutions LLC and are protected by applicable intellectual property laws.

These Terms grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal and lawful purposes.

You may not, without prior written permission:

  • Copy;
  • Republish;
  • Modify;
  • Distribute;
  • Sell;
  • License;
  • Scrape;
  • Reproduce;
  • Create derivative works from; or
  • Commercially exploit

any part of the Services.

HairMed™ is used as a trademark of KSS Global Solutions LLC. The use of the ™ symbol does not represent that federal trademark registration has necessarily been granted.


SECTION 15 — OPTIONAL THIRD-PARTY TOOLS

The Services may include tools, software, integrations, applications, clinical platforms, payment systems, subscription applications, fulfillment providers, or other services operated by third parties.

Third-party tools may be provided “as is” and “as available.”

Your use of a third-party tool may be subject to separate terms and privacy policies.

We are not responsible for third-party services outside our control, except to the extent required by applicable law.


SECTION 16 — THIRD-PARTY LINKS

The Services may contain links to websites or resources operated by third parties.

We do not control and are not responsible for the content, security, availability, accuracy, or privacy practices of third-party websites.

You access third-party sites at your own discretion.

Questions or disputes concerning a third party’s products or services should be directed to that third party.


SECTION 17 — RELATIONSHIP WITH SHOPIFY

HairMed’s online store is powered by Shopify.

All sales and customer transactions made through HairMed are directly between you and KSS Global Solutions LLC, not Shopify.

Shopify is not responsible for:

  • HairMed products;
  • Clinical decisions;
  • Medical care;
  • Treatment plans;
  • Fulfillment;
  • Shipping;
  • Refunds;
  • Customer service;
  • Product results; or
  • Disputes between you and HairMed.

To the maximum extent permitted by law, you release Shopify and its affiliates from claims arising directly from transactions between you and HairMed.


SECTION 18 — PRIVACY

Our collection, use, disclosure, and protection of personal information are described in our Privacy Policy:

Certain clinical information may also be governed by additional healthcare privacy notices or consents, when applicable.

Because the store is hosted through Shopify, certain information may be processed by Shopify and other service providers to operate, secure, and improve the Services.

You are responsible for reviewing the applicable Privacy Policy and clinical privacy documentation before submitting sensitive information.


SECTION 19 — FEEDBACK AND REVIEWS

If you submit reviews, feedback, photographs, suggestions, ideas, testimonials, or other content (“Feedback”), you represent that:

  • You own or control the necessary rights;
  • The content is truthful;
  • It does not violate another person’s rights;
  • Any incentive or compensation has been properly disclosed; and
  • It complies with applicable law.

You grant HairMed a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, adapt, and distribute the Feedback for operating, improving, and promoting the Services.

We may remove Feedback that we reasonably believe is false, unlawful, abusive, misleading, infringing, or otherwise inappropriate.

We are not required to:

  • Keep Feedback confidential;
  • Compensate you;
  • Publish Feedback; or
  • Respond to Feedback.

SECTION 20 — ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain errors or omissions involving:

  • Product descriptions;
  • Availability;
  • Pricing;
  • Promotions;
  • Subscription terms;
  • Shipping;
  • Processing times;
  • Images; or
  • Other information.

We reserve the right to correct errors, update information, or cancel affected orders when permitted by law.

If an order is canceled due to our error, any applicable payment will be refunded.


SECTION 21 — PROHIBITED USES

You may not use the Services to:

  • Violate any law or regulation;
  • Commit fraud;
  • Submit false medical, payment, or identity information;
  • Obtain a product for another person;
  • Resell or unlawfully distribute products;
  • Impersonate another person;
  • Harass or threaten another person;
  • Infringe intellectual property rights;
  • Upload malware or harmful code;
  • Attempt unauthorized access;
  • Interfere with the website;
  • Scrape or extract data without authorization;
  • Circumvent security or eligibility controls;
  • Abuse refunds, promotions, subscriptions, or chargebacks; or
  • Use the Services for unlawful or harmful purposes.

We may restrict, suspend, or terminate access if we reasonably believe these Terms have been violated.


SECTION 22 — TERMINATION

You may stop using the Services at any time.

We may suspend or terminate your access, account, order, or subscription when:

  • You violate these Terms;
  • Payment remains unpaid;
  • Fraud or misuse is suspected;
  • Continued service creates a safety concern;
  • A provider discontinues treatment;
  • Required information is not supplied; or
  • Termination is required by law.

Termination does not eliminate:

  • Charges already incurred;
  • Orders already processed;
  • Payment obligations under an applicable initial term;
  • Rights or obligations intended to survive termination; or
  • Responsibilities created before termination.

SECTION 23 — DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE NON-CLINICAL PORTIONS OF THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

HAIRMED DOES NOT WARRANT THAT THE WEBSITE WILL ALWAYS BE:

  • UNINTERRUPTED;
  • ERROR-FREE;
  • SECURE;
  • AVAILABLE; OR
  • FREE FROM HARMFUL COMPONENTS.

WE DO NOT GUARANTEE ANY SPECIFIC HAIR, COSMETIC, OR TREATMENT RESULT.

Nothing in this section limits rights that cannot legally be excluded or limits the professional responsibilities of a licensed healthcare provider.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.


SECTION 24 — LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KSS GLOBAL SOLUTIONS LLC, HAIRMED™, AND THEIR AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE SERVICES.

This may include loss of profits, data, opportunity, revenue, or business.

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, willful misconduct, or other liability that applicable law prohibits us from limiting.

These Terms do not attempt to limit the independent professional obligations or legally non-waivable liability of licensed healthcare providers.


SECTION 25 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless KSS Global Solutions LLC, HairMed™, Shopify, and their respective affiliates, personnel, agents, contractors, and service providers from third-party claims arising from:

  • Your violation of these Terms;
  • Your violation of applicable law;
  • Your misuse of the Services;
  • Your infringement of another person’s rights; or
  • False information knowingly submitted by you.

This obligation does not apply to claims caused by the gross negligence, willful misconduct, or unlawful conduct of an indemnified party.


SECTION 26 — SEVERABILITY

If any provision of these Terms is determined to be illegal, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or separated from the Terms.

The remaining provisions will continue in effect.


SECTION 27 — WAIVER AND ENTIRE AGREEMENT

Failure to enforce any right or provision does not constitute a waiver.

These Terms and the policies incorporated by reference constitute the entire agreement between you and HairMed regarding the Services, except for separate clinical, telehealth, privacy, pharmacy, or informed-consent agreements that apply to specific services.


SECTION 28 — ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms as part of a:

  • Reorganization;
  • Merger;
  • Acquisition;
  • Sale of assets;
  • Financing;
  • Affiliate transfer; or
  • Similar transaction,

subject to applicable law.


SECTION 29 — GOVERNING LAW AND VENUE

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where the law of your state provides non-waivable consumer protections.

Subject to applicable law, disputes relating to the non-clinical Services will be brought in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction.

Clinical disputes may be governed by separate provider agreements, informed consents, or applicable professional laws.


SECTION 30 — CHANGES TO THESE TERMS

We may update these Terms from time to time.

The current version will be posted on this page with the updated date.

When required by law, we will provide notice of material changes.

Your continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms, except where affirmative consent is legally required.
